Terms of Use

1. Eligibility and accounts

You must be at least 13 and meet any higher minimum age required where you live. If you are below the age of legal adulthood, your parent or guardian must review and agree to these Terms and supervise your use. You must be legally capable of agreeing to these Terms, or have that parent or guardian’s permission. If you use the Service on behalf of another person or organization, you represent that you are authorized to accept these Terms for them. You are responsible for maintaining the security of your account and for activity that occurs through it. Information you provide must be accurate and kept current.

2. The Service

Words First helps you collect, organize, discover, and practice vocabulary. Features and supported languages may change as the Service develops. Dictionary information, translations, pronunciations, examples, and learning indicators are educational aids and may contain errors or omissions. They are not professional advice or a guarantee of fluency or learning outcomes.

3. Your content

You retain ownership of words, meanings, examples, notes, questions, and other content you add to the Service (“User Content”). You grant Yellowbeak a worldwide, non-exclusive, royalty-free license to host, process, copy, transmit, and display User Content only as reasonably necessary to operate, secure, synchronize, and improve the Service. You are responsible for your User Content and must have the rights needed to provide it.

This includes processing relevant User Content through our AI service provider to fulfill your requests, and using service providers such as Langfuse Cloud to evaluate answer quality, monitor performance, troubleshoot problems, and investigate misuse. Our Privacy Policy explains what information is shared and how we handle it. We have disabled optional sharing of this API data with OpenAI for model training and improvement. These Terms do not replace any separate permission required for sharing personal information.

4. Acceptable use

You may not:

• use the Service for unlawful, fraudulent, or abusive activity;
• interfere with its operation, security, or other users;
• attempt to gain unauthorized access to accounts or systems;
• introduce malicious code or evade technical usage limits;
• scrape, copy, or redistribute the Service or licensed dictionary content except as permitted by law; or
• use the Service to infringe another person’s rights.

5. Subscriptions and automatic renewal

Words First may offer free and paid features. The price, billing period, and included features are shown before purchase. Paid annual subscriptions renew automatically unless canceled through your Apple App Store or Google Play account before renewal. The applicable store bills your selected payment method and manages renewal, cancellation, taxes, and payment processing under its own terms.

Canceling stops future renewal but does not ordinarily end access before the current paid period expires. Deleting the app or your Words First account does not automatically cancel a store subscription.

6. Refunds

Except where required by applicable law or the policies of the applicable app store, subscription payments are final and non-refundable. Yellowbeak does not voluntarily provide refunds or credits for partially used subscription periods. Refund requests for purchases made through the Apple App Store or Google Play are handled in accordance with the applicable store’s policies. Nothing in these Terms limits any mandatory consumer rights.

7. AI features and usage limits

AI Tutor responses, generated example sentences, and Daily Tips are generated using OpenAI. You are interacting with an automated system, not a human teacher. These features are intended for language learning and may decline unrelated or unsafe requests. They may be subject to reasonable usage limits. We may introduce or modify message quotas, rate limits, access periods, or feature availability to maintain service quality, manage operating costs, prevent misuse, and protect users. We will provide notice of material changes where reasonably practicable or legally required.

Paid access does not mean unlimited AI use. Limits can apply per conversation and per month, and availability also depends on service capacity and safety controls. Starting a new conversation does not reset monthly usage. The app displays applicable usage information.

AI-generated output may be inaccurate, incomplete, or inappropriate. You should independently check important information and must not rely on AI features for professional, medical, legal, financial, or safety advice.

AI output may not be unique, and other users may receive similar output. You are responsible for how you use or share it and for respecting others’ rights. Do not submit sensitive personal information or information you are not authorized to share, and do not attempt to bypass safeguards or extract confidential instructions or another user’s information.

8. Subscription price changes

We may change the price of an annual subscription. A price increase affecting an existing subscriber will apply no earlier than the next eligible renewal after at least 30 days’ notice, or any longer notice period required by applicable law or the applicable app store. Apple or Google may require additional notice or your consent. You may cancel before the affected renewal to avoid being charged the new price.

9. Intellectual property and licenses

The Service, including its software, design, branding, and content other than User Content, is owned by Yellowbeak or its licensors and protected by law. Subject to these Terms, Yellowbeak grants you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial language learning. Restrictions in these Terms do not take away permissions granted by an applicable open-content or open-source license. Dictionary sources and other third-party materials remain subject to their respective licenses and notices.

10. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you materially violate these Terms, create risk or harm, or use the Service unlawfully. We may discontinue the Service with reasonable notice where practicable. Provisions that by their nature should survive termination will remain in effect.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Yellowbeak disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will always be available, secure, accurate, complete, or error-free. Some jurisdictions do not allow certain exclusions, so some may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, Yellowbeak and its members, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from the Service or these Terms. Yellowbeak’s total liability for all claims relating to the Service or these Terms will not exceed the greater of the amount you paid for the Service during the preceding twelve months or one hundred U.S. dollars (US $100). These limitations do not apply where prohibited by law, including to liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence where that liability cannot lawfully be limited.

13. Changes to these Terms

We may update these Terms as the Service or legal requirements change. We will post the revised Terms and update the effective date. We will provide additional notice when required by law. Continued use after revised Terms take effect means you accept them.

14. Governing law

These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law rules. Any dispute relating to these Terms or the Service must be brought in the state or federal courts located in Rhode Island, and you consent to their jurisdiction and venue. If any provision is unenforceable, the remaining provisions remain in effect. If you are a consumer in the EEA or UK, this choice of law does not deprive you of mandatory protections under the laws of your country of habitual residence, and this venue provision does not restrict your right to bring proceedings in your local courts where applicable law gives you that right. Mandatory consumer protections applicable to you are not limited by these Terms.
